1. About Us

Madoc Books is an independent bookseller specialising in rare, antiquarian and collectible books, including works of Welsh interest, angling, mountaineering, history, illustrated and colour plate books, private press publications and finely bound works.

For the purposes of consumer protection legislation, Patrick M. Elliott trading as Madoc Books is the “trader”.

2. Application of These Terms

These Terms and Conditions apply to all contracts for the sale of goods made:

  • Through our website (www.madocbooks.com)
  • Via third-party marketplaces (including AbeBooks)
  • By email, telephone or other distance communication

If you are purchasing as a consumer, nothing in these Terms affects your statutory rights.

If you are purchasing in the course of a business, statutory consumer cancellation rights do not apply.

3. Pre-Contract Information

Before you are bound by a contract, we will provide:

  • Our trading name and geographical address
  • A description of the goods
  • The total price
  • Delivery costs
  • Payment arrangements
  • Delivery arrangements
  • Information about your right to cancel (if applicable)
  • Details of who bears return costs

This information forms part of the contract.

4. Formation of Contract

A listing, catalogue entry or website description constitutes an invitation to treat.

A legally binding contract is formed only when we confirm dispatch of the goods.

We reserve the right to refuse or cancel an order before dispatch where:

  • The item is unavailable
  • There is an obvious pricing or description error
  • Payment authorisation fails
  • We reasonably suspect fraud or unlawful activity

If an order is cancelled before dispatch, a full refund will be issued without undue delay.

When placing an order through our website, the order button will clearly indicate that placing the order creates an obligation to pay.

5. Description and Condition of Antiquarian and Second-Hand Books

We take reasonable care to ensure bibliographic descriptions, collation details, provenance statements and condition reports are accurate.

Rare and second-hand books are not new goods. They may show:

  • Signs of age, wear, foxing or toning
  • Repairs, rebacking or restoration
  • Annotations or previous ownership inscriptions
  • Other historic characteristics

Such features are not defects but part of the nature of antiquarian material.

Condition descriptions are provided in good faith and form part of the contract.

Unless expressly stated:

  • Dust jackets are not guaranteed to be free from restoration or price-clipping
  • Minor bibliographic variations consistent with the edition may exist

Any known significant restoration, facsimile material or defects affecting completeness will be disclosed.

6. Pricing

All prices are stated in pounds sterling (£).

Madoc Books is not VAT registered. VAT is not chargeable on our sales and VAT invoices cannot be issued.

The total price payable will be confirmed before you place your order and will include:

  • The price of the goods
  • Delivery charges

We do not impose surcharges for card payments.

Currency conversion charges or foreign bank fees are the responsibility of the customer.

7. Payment

Payment must be made in full before dispatch unless otherwise agreed.

Title to the goods will not pass until payment has been received in cleared funds.

8. Delivery

Orders are normally dispatched within 2–3 working days unless otherwise stated.

Delivery may be made by Royal Mail or recognised courier services.

Delivery times are estimates and not guaranteed unless expressly agreed.

Unless otherwise agreed, goods will be delivered within 30 days of order acceptance.

If we fail to deliver within the agreed period, you may require delivery within an additional reasonable time. If delivery is still not made within that period, you may treat the contract as at an end and receive a full refund.

Risk

For consumer sales, risk passes when goods come into your physical possession or that of a person identified by you to take possession.

For business sales, risk passes upon delivery to the agreed address.

9. International Sales

We ship worldwide.

For customers outside the United Kingdom:

  • You are responsible for customs duties, import taxes, tariffs and clearance fees
  • These charges are not included in the purchase price or delivery charge
  • We are not responsible for customs delays

If you are a consumer resident outside the United Kingdom, nothing in these Terms affects any mandatory consumer protection rights you may have under the law of your country of residence.

These Terms do not deprive you of the protection afforded to you by provisions that cannot be derogated from by agreement under the law of the country in which you are habitually resident.

Consumer Rights

(These sections apply only to consumers purchasing at a distance.)

10. Right to Cancel

You have the right to cancel your contract within 14 days without giving any reason.

The cancellation period expires 14 days after the day on which you, or a person nominated by you (other than the carrier), take physical possession of the goods.

To exercise the right to cancel, you must inform us of your decision by a clear statement (for example, a letter sent by post or email).

You may use the cancellation form at the end of these Terms, but this is not obligatory.

We will bear the cost of returning the goods where you exercise your statutory right to cancel within the 14-day cancellation period.

The right to cancel does not apply to goods made to the consumer’s specifications or clearly personalised, goods sealed for health protection or hygiene reasons once unsealed after delivery, or other goods exempted under Regulation 28 of the Consumer Contracts Regulations.

11. Effects of Cancellation

If you cancel within the 14-day period, we will reimburse:

  • The price paid for the goods; and
  • The cost of the least expensive standard delivery method offered

We will not reimburse premium delivery charges.

Refunds will be made within 14 days of:

  • Receiving the returned goods; or
  • Receiving evidence that they have been sent back

Whichever is earlier.

Refunds will be made using the original payment method unless otherwise agreed.

We may withhold reimbursement until goods are received or proof of return is provided.

12. Condition on Return

You must return goods within 14 days of notifying cancellation.

You are liable only for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Where we bear the cost of return, we will provide a prepaid return label or arrange collection. If you choose an alternative return method without our agreement, you remain responsible for the goods until they are received by us.

We reserve the right to require the use of an insured and trackable return service for items of significant value.

13. Faulty or Misdescribed Goods

Under the Consumer Rights Act 2015, goods must be:

  • As described
  • Of satisfactory quality (taking into account age and description)
  • Fit for purpose

If goods fail to conform:

  • You may reject within 30 days for a full refund
  • You may request repair or replacement (where possible)
  • If repair or replacement is not possible or fails, you may seek a price reduction or final rejection

If a fault becomes apparent within 12 months, it is presumed to have existed at delivery unless proven otherwise.

We will reimburse reasonable return costs for faulty or misdescribed goods.

14. Force Majeure

We shall not be liable for failure or delay in performing our obligations where such failure or delay results from events beyond our reasonable control.

15. Complaints

We aim to resolve complaints promptly and fairly.

If you have any concerns about goods or services supplied by us, please contact us using the details set out above and we will seek to resolve the matter as quickly as possible.

We are not obliged to participate in alternative dispute resolution and do not subscribe to an ADR scheme, but we are willing to consider alternative dispute resolution where appropriate.

16. Limitation of Liability

Nothing in these Terms excludes or limits liability for:

  • Death or personal injury caused by negligence
  • Fraud or fraudulent misrepresentation
  • Breach of statutory rights
  • Any liability which cannot lawfully be excluded

Subject to the above, our total liability shall not exceed the purchase price paid.

17. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you may bring proceedings in your country of residence and may rely on mandatory local consumer protection provisions.
